Bar Examinations 2012

The annual Bar Examinations administered by the Supreme Court will be held on October 7, 14, 21 and 28, 2012 at the University of Santo Tomas in EspaƱa, Manila.

This year's Committee on Bar Examinations is chaired by Supreme Court Associate Justice Martin S. Villarama, Jr.

In all four Sundays of October, the UST gates will open at 5:00 a.m. for the Bar examinees and will close at 7:30 a.m.. The first Sunday is allotted for Political Law with a corresponding weight of 15% on the examinee's general average, and Labor and Social Legislation with a weight of 10%; second Sunday, Civil Law (15%) and Taxation (10%); third Sunday, Commercial Law (15%) and Criminal Law (10%); and fourth Sunday, Remedial Law (20%) and Legal Ethics and Practical Exercises (5%).

Per Bar Matter No. 2502, a Supreme Court En Banc Resolution, the exam for each subject will be composed of 60% multiple-choice questions and 40% essay questions. The multiple-choice portion will corrected electronically while the essay portion will be corrected by the examiner manually.

The practical exercises portion of the last exam will be in the form of a Trial Memorandum Writing Test.

Judicial Affidavit Rule

Starting January 1, 2013, all courts in the Philippines will adopt the rule on judicial affidavit. Supreme Court Administrative Matter No. 12-8-8-SC or the Judicial Affidavit Rule aims to address the problem of congestion and delays in most courts arising from so many cases filed each year and how slow the courts are in resolving them. This can be achieved by reducing the time needed for completing the testimonies of witnesses.

As such, the new rule requires parties to file with the court and serve on the adverse party, not later than five days before the pre-trial or preliminary conference or the scheduled hearing of a motion, the judicial affidavits of their witnesses which shall take the place of such witnesses' direct testimonies, including the documentary or object evidences to be attached and marked as exhibits.

The judicial affidavit shall also have a sworn attestation at the end by the lawyer who conducted or supervised the examination of the witness. The lawyer will attest that he recorded the question and answer, and that nobody coached the witness regarding the latter's answers.

Philippine Bar Examinations, October 2012

Next month, October, the Philippines will once again hold its annual Bar examinations which is administered by the Supreme Court every Sunday of such month. As part of the reforms in the exams started in 2009, which started with the two-examiners per subject rule, this year's exams reportedly will still follow the modified format of mixed essay type (40%) and multiple choice type (60%).

According to the Inquirer.net report, the exams will revert to the two subjects per Sunday format unlike last year where two Sundays had three subjects to accommodate the memorandum and legal opinion writing on the last day. In keeping with the policy to be transparent with the actual coverage of the exams and to focus on the basics of the law, the Supreme Court has published online the syllabus for each of the subjects covered in the exams.
